1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of jollyjunctioncottages.makeup (the "Site"), operated by Jolly Junction Editorial SRL, company number BE 0784.512.369, Rue des Minimes 41, 1000 Brussels, Belgium ("we", "us", "our"). By accessing the Site you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.
2. Nature of the service
The Site is an independent editorial catalogue that describes selected luxury hotels in Brussels, Belgium, together with information about districts, facilities and nearby attractions. We are not a travel agency, tour operator, online travel agency or booking intermediary. We do not offer, sell, reserve or confirm accommodation, and we do not collect payments.
All buttons labelled "Visit Official Website", "Book Direct" or "Check Hotel" take you to the hotel's own website or official booking engine. Availability, rates, reservation policies, cancellation terms and booking transactions are handled exclusively by the respective hotel or its official booking system. Any contract for accommodation is formed solely between you and the hotel.
3. User obligations
When using the Site you agree that you will:
- use the Site only for lawful, personal and non-commercial purposes;
- not attempt to gain unauthorised access to the Site, its servers or any connected systems;
- not introduce viruses, malware or any code designed to disrupt or damage the Site;
- not use automated systems, including scrapers, crawlers or bots, to extract content in bulk without our prior written consent, except for standard search engine indexing;
- not impersonate any person or misrepresent your affiliation with any organisation when contacting us;
- provide accurate information when submitting the contact form and not send unlawful, abusive, defamatory or spam content;
- independently verify all information that is material to your travel decisions directly with the relevant hotel.
4. Accuracy of information
We research our content carefully and update it regularly. However, hotels may change their facilities, restaurants, opening hours, renovation status, operators or policies without notice. Walking times are approximate and measured on foot under normal conditions. Atmosphere photography on the Site is editorial and illustrative and may not depict the specific hotel. We make no warranty that any information is complete, current or error-free, and it should not be treated as a substitute for confirmation from the hotel.
5. Intellectual property rights
All original text, page layouts, graphics, the Jollyjunctioncottages name and logo, icons, code and the selection and arrangement of content on the Site are owned by or licensed to Jolly Junction Editorial SRL and are protected by Belgian, European and international copyright, trademark and database laws. Photography is used under the Unsplash License or other applicable licences and remains the property of the respective photographers.
You may view, download and print pages for your personal, non-commercial use, and you may share links to the Site. You may not reproduce, republish, distribute, modify, create derivative works from or commercially exploit any content without our prior written permission. Hotel names and trademarks belong to their respective owners and are used for identification only; their use does not imply endorsement or affiliation.
6. Third-party links
The Site contains links to hotel websites, booking engines, museums, tourism boards and other third-party resources. We do not control these websites and are not responsible for their content, availability, privacy practices, pricing, products or services. Accessing a third-party website is at your own risk and subject to that website's terms.
7. Limitation of liability
To the fullest extent permitted by applicable law, the Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Jolly Junction Editorial SRL, its directors, employees and contributors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, bookings, data, goodwill or travel arrangements, arising out of or in connection with your use of, or inability to use, the Site or any linked website. We are not liable for any act, omission, pricing, overbooking, cancellation, quality of service or dispute relating to a hotel or its booking system.
Where our liability cannot be excluded, it is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under Belgian consumer protection law, including Book VI of the Belgian Code of Economic Law.
8. Indemnity
You agree to indemnify and hold harmless Jolly Junction Editorial SRL from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
9. Termination
We may suspend or terminate your access to the Site, in whole or in part, at any time and without prior notice if we reasonably believe you have breached these Terms, if required by law, or for technical or security reasons. We may also modify, suspend or discontinue the Site or any part of it at any time. Sections 5, 7, 8, 10 and 11 survive any termination.
10. Governing law
These Terms and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by the laws of Belgium. If you are a consumer residing in another EU Member State, you also benefit from any mandatory provisions of the law of your country of residence.
11. Dispute resolution
We encourage you to contact us first at [email protected] so we can try to resolve any concern informally. We will acknowledge complaints within five working days and aim to resolve them within thirty days.
If a dispute cannot be resolved amicably, consumers may refer it to the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur), North Gate II, Boulevard du Roi Albert II 8, 1000 Brussels. Subject to mandatory consumer protection rules, the courts of Brussels shall have exclusive jurisdiction.
12. Changes to these terms
We may revise these Terms from time to time. The revised version takes effect when published on the Site, as indicated by the "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
